Wrongful Death Claim Recoverable Compensation

If your loved one is killed by the negligence of another driver in a two-vehicle collision, immediate family members might be able to file a wrongful death claim. This right primarily extends to the deceased’s spouse or children. If no spouse or children are present, the deceased’s parents and siblings may pursue the claim. After a Red Bluff fatal collision, the following types of damages may be recoverable:

  • Loss of income and other benefits the deceased would have earned until retirement, including insurance and pension benefits.
  • Costs associated with burial, funeral, or cremation services.
  • Compensation for the spouse’s lost affection and companionship.
  • Compensation for the children’s loss of parental care and guidance.
  • Compensation for the loss of household services the deceased provided.

Filing a wrongful death claim can help ensure the financial protection of those left behind, allowing them to cover unexpected expenses following the loss of a loved one.

How an Accident Attorney Proves Fault

Proving fault in a fatal two-vehicle collision involves several crucial steps that an accident attorney will undertake:

  • Conducting a thorough investigation to collect all pertinent evidence, such as police reports, witness statements, and any available surveillance footage.
  • Collaborating with accident reconstruction experts to recreate the accident scene and determine how the incident occurred. The attorney will also scrutinize the background and actions of the involved parties to identify any contributing negligence or recklessness.
  • Reviewing medical records and obtaining expert testimonies to establish the cause of death and its direct connection to the accident.
