Cement Truck Rollover Accidents Commonly Occur

Cement trucks are large and heavy vehicles, and a rollover accident involving one can result in severe injuries and fatalities for those in nearby cars. Cement trucks’ high center of gravity makes them particularly prone to rollovers, especially when turning a corner. In addition, the driver inside has a poor view of surrounding traffic, making an accident more likely to occur.

Common Contributing Factors in Cement Truck Accident

Several common factors contribute to cement truck accidents. One of the primary reasons is driver fatigue, as operating a cement truck often involves long hours behind the wheel, leading to decreased alertness and slower reaction times. Another significant factor is mechanical failure; cement trucks require regular maintenance to ensure that all parts, such as brakes and tires, are in good working condition. Improper loading can also be problematic, as uneven weight distribution affects the vehicle’s balance and maneuverability. Additionally, poor weather conditions, including rain, snow, and ice, can make the roads slippery, increasing the risk of accidents. Lastly, driver error, such as speeding, distracted driving, or ignoring traffic laws, plays a crucial role in many cement truck incidents.

Cement Truck Accident Compensation Recovery

If you are injured in an accident with a cement truck, the driver and the employing company may be held accountable. Under the doctrine of respondeat superior, the company owner is responsible for the negligence of their employees. Negotiating with a company that has legal representation can be challenging without proper legal assistance. An injury lawyer who handles cement truck accidents can help you recover:

  • Medical expenses: This includes everything from the ambulance ride and hospital stay to physicians’ bills and physical therapy sessions. If your injury requires ongoing treatment, your lawyer can estimate future medical costs to include in the settlement.
  • Lost wages: Compensation for wages lost due to your injury can be recovered, along with the value of benefits such as insurance and pension contributions you missed.
  • Pain and suffering: This compensation covers both physical pain and emotional distress, including conditions like post-traumatic stress disorder (PTSD), and the costs associated with its treatment.
