Interstate 5 Accident Involves Multiple Vehicles
Road debris caused major problems for numerous vehicles in Sacramento on January 13 by causing a traffic collision. The accident, which reportedly included four vehicles, happened around 3:44 p.m. on southbound Interstate 5 north of the Florin Road exit ramp, according to the California Highway Patrol (CHP). A large piece of concrete was blocking the third lane, which caused vehicles on the road to swerve to try and avoid it.
Further Information About the Road Debris Accident
A number of vehicles were struck with debris or crashed into it. According to one caller, a sedan on the right-hand side of the highway appeared to have been struck by debris. Others were reportedly hit also. A pothole was discovered between lanes two and three, and it is possible the concrete and debris came from that source. Injuries were reported, but no details were provided. At least one vehicle had to be towed from the scene of the road debris accident.
Placing a Claim Against a Government Entity
In the case of highways, Caltrans is in charge in California for their maintenance. For streets or smaller roads, the city, county, or state may be in charge. Filing against a government entity has a different timeline before the statute of limitations runs out. If a claim is filed too late, it will probably not be heard in court.
Filing Against a Government Entity
A claimant in California has six months in which to file for damages. Once the government entity receives that claim, they have 45 days in which to respond. If the response is yes, the claim can go forward. If the agency says no, the claimant has six months in which to file a government claim in court. If the agency does not respond, the claimant has two years to file a court claim.
Investigating a Government Entity Accident
As with other personal injuries, we send our investigators to the accident site. There, they are able to talk to witnesses who saw the accident happen and can provide an unbiased report on what occurred. They obtain videos of the accident from both traffic light surveillance cameras and security units used on many businesses in the area. Accident reconstruction techniques are used to envision the incident as it happened and obtain needed information about the positioning of the vehicles during the crash.
Our investigators also examine the roads to see if government agency negligence in terms of maintenance was involved. They obtain copies of the police report and review it for errors. If a government agency fails in its responsibility to provide safe roadways for all motorists and pedestrians, they may be held financially liable for any injuries or fatalities.
