Who is responsible for these accidents?
Car accidents usually happen when one or more drivers have been negligent in some way while operating his or her vehicle.
Motorists have a duty to exercise reasonable care when operating a motor vehicle. Driving in excess of the posted speed limit, failing to use turn signals, ignoring traffic signs, etc. may be used as evidence of someone’s negligence in causing an auto accident.
Similarly, there are other actions a driver may be doing which are distracting and extremely unsafe. These include, talking on a cell phone while driving (which in California is illegal without a hands-free device) or text messaging. Even eating while driving is a form of distracted driving that can later be proved to have caused or contributed to the cause of an accident. All these are good examples of evidence which may be used to determine fault in an auto accident case.
Examples of Driver Negligence:
- Unsafe Speed
- Distracted Driving – Failure to Pay Attention
- Failure to Yield the Right of Way
- Vehicle Defects (For example, brake lights out)
- Making Illegal Turns
- Failure to use Turn Signals
- Failure to travel at a Safe Following Distance, etc.
The above information is just an overview that may give you a general idea of driver negligence. Remember, If you violate the laws of the highway, and your negligence contributes to or is the cause of an auto accident, you may be found responsible for that accident.
