Recoverable Compensation in a Pedestrian Injury Collision
If a negligent driver or other party in a Rocklin major injury crash has caused injuries to a pedestrian, the injured individual may be entitled to the following forms of compensation:
- Medical expenses: Injured pedestrians may claim reimbursement for both past and future medical expenses, which can include costs related to hospitalization, surgeries, and rehabilitation.
- Lost wages: Should the injuries sustained in the collision prevent you from working, you may seek compensation for the income lost during your recovery period.
- Ongoing losses: If injuries persist beyond the settlement, any extra medical costs or job-related losses can be included. In cases of permanent disability, lost wages and benefits can be claimed until retirement age. If the individual is able to return to work but must accept a lower-paying position due to their injuries, the difference in salary is recoverable.
- Pain and suffering: Compensation may also be sought for the physical pain and emotional distress resulting from the injuries sustained.
- Punitive damages: In instances where the injuries were caused by intentional acts or extreme negligence, the injured pedestrian may be awarded punitive damages in addition to the aforementioned compensation. These damages are designed to deter similar future behavior and to penalize the responsible party.
