What You Should Know About Car Accident Injury Cases
As a party injured in a motor vehicle collision through no fault of your own, the whole ordeal can be stressful and overwhelming. However, it is useful to know that you may be able to seek reimbursement for your losses through a bodily injury claim. For instance, you may seek recovery of medical bills for treatment of accident-related injuries. If any time was missed at work to recover from the incident, you may be compensated for wage loss. If traumatic injuries prevented you from working in the same position you held before the crash or even working at all, you may seek compensation for lost future earning capacity.
The California Code of Civil Procedure Section 335.1 limits the amount of time an injured party has to file a lawsuit if a mutual settlement agreement is not reached within that period. An injured person has only two years from the date of the crash to file a lawsuit in court. After two years have passed and a lawsuit has not been filed, the injured party loses the right to seek compensation for their damages. To protect your right to financial recovery, it is essential to work with an experienced car accident lawyer to ensure that all deadlines are met in your case. Your lawyer will also work to ensure that evidence is gathered and preserved until it disappears or gets destroyed over time.
