Fatal Motorcycle Accident Occurs at Sunrise Avenue Intersection
A fatal motorcycle accident happened in Roseville on April 8 in a solo vehicle collision. The crash occurred along Sunrise Avenue at its intersection with Oak Ridge Drive during the morning hours. Officers with the Roseville Police Department said that skid marks were found on a cement curb dividing the south and northbound lanes as they turn into Interstate 80. The motorcycle was found stuck between a chain-link fence and a metal post.
One Motorcycle Occupant Hospitalized With Severe Injuries
One of the riders on the motorcycle died, while the other was said to have suffered life-threatening injuries and was transported to a hospital for additional treatment and evaluation. Sunrise Avenue between Frances and Oak Ridge drives was shut down while an investigation was conducted into the accident.
Factors Contributing to a Fatal Motorcycle Accident
Motorcycles have just two wheels as opposed to the four on a passenger vehicle, so they are more likely to be involved in an accident. This is why many riders are cautious on their motorcycles. There are, however, situations in which a motorcycle accident is caused by something outside the rider’s control, and the family can file a wrongful death suit in these instances. This includes the following types of negligence:
- Motorcycle parts that are defective: A defective brake system or tire as well as problems with the fuel system, can lead to a fatal motorcycle accident. After a collision, the motorcycle should be kept so that possible defects can be detected. A product liability claim may be used to hold the manufacturer, parts maker and others responsible for your loved one’s death due to a defect.
- Poor roadway maintenance: Inadequate maintenance of the roadway can cause a fatal motorcycle accident when potholes, oil, debris, and upheavals in the pavement exist. In those cases, the maintenance authority can be held liable. It may, however, be beneficial to get advice from an injury lawyer since the statute of limitations for filing a lawsuit against a government entity is shorter than that for other personal injuries. In a case against a government entity, the injured person has only six months in which to file a claim.
- Traffic accidents: Injuries and deaths resulting from negligent drivers are common among motorcycle riders. A few examples of such negligence include turning in front of a rider, speeding, and being distracted or drunk behind the wheel. Usually, the family of the deceased or the estate of the decedent can recover damages in a wrongful death case when a negligent driver causes the death of a loved one.
California Wrongful Death Claims: Who Can File Them?
As well as members of the immediate family, the representative of the deceased’s estate may file a wrongful death claim in California. The children, as well as the spouse of the deceased can file a claim. The parents and siblings of the deceased may file a claim for wrongful death if the decedent was unmarried. If your loved one has passed away, a Roseville wrongful death lawyer can inform you of how a claim is filed and who can file for damages.
Combating Negative Views of Motorcyclists
