RV Accident Occurs When Vehicle Rolls at Gabby Road Intersection
A solo vehicle RV accident in Arbuckle on July 16 caused two people to be airlifted to a hospital for medical care. The accident happened around 1:39 p.m. at the intersection of Gabby and Greenbay Roads when, for undetermined reasons, the motorhome overturned. The incident report by the California Highway Patrol (CHP) said the accident didn’t block the roadway.
Two People Airlifted After Rollover RV Accident
The 41-foot RV was off to the right-hand side, laying on top of a car the vehicle was towing. Emergency responders were called to assess injuries, and two patients were airlifted to a hospital for medical treatment. CHP traffic collision investigators are scrutinizing the RV collision to determine why it happened.
Accident Causes
Most traffic accidents occur because of negligence by the driver. For example, driving too fast or becoming distracted, to just being too tired to be behind the wheel of a vehicle can cause an RV accident. Outside influences that can lead to these types of collisions include:
- Poor roadway maintenance or design: It can cause severe collisions if the lanes at an intersection are too narrow, or if visibility is poor because of landscape features or other obstructions. Many other issues can contribute to an accident at an intersection, such as inadequate overhead lighting, mistimed traffic signals, and many others. A government entity responsible for design and maintenance may be liable for accident injuries, but there is a six-month statute of limitations. It is a good idea to hire an accident lawyer to ensure that paperwork is filed on time. The court will not hear the case if this is not done.
- Animals crossing the roadway: When animals unexpectedly cross or block the road, it may cause an RV accident. If the animals are livestock, the owner may be responsible for injuries.
- The failure of defective parts or manufacturing flaws can cause a vehicle to suddenly malfunction, causing a loss of control. One of the reasons why maintaining a vehicle after an accident is essential is to be able to inspect it. Product liability damages may be recovered if a defect caused the collision.
Compensation for Personal Injuries
An injury caused by someone’s negligence can be compensated by filing a personal injury claim. An injured person may be able to recover damages such as:
- Expense reimbursement for medical care
- Employees who are unable to work as a result of injury may claim lost wages. If the injured party becomes permanently disabled or has to take a lower-paying job because of their injury, this can be calculated into the damages
- Loss of consortium
- Compensation for the physical and psychological pain and suffering
- An award of punitive damages is sometimes available to punish negligent or intentional conduct by the responsible party
