Fatality Accident Reported at Florin Road Intersection

A fatality accident involving a dump truck and sedan occurred in Sacramento on May 14. The accident occurred at the Florin Road intersection with Power Inn Road, according to a report by the Sacramento Metropolitan Fire District. Medics transported two people to a hospital. One reportedly suffered critical injuries, while the other patient’s injuries were minor to moderate. One person expired from the physical trauma caused by the crash. The accident is under investigation by authorities to find out what caused the collision.

Accidents Involving Large Trucks

Large trucks are a common cause of a fatality accident in those who are riding in smaller vehicles. When the accident is caused by the truck driver or company they work for, negligence may include one of the following causes:

  • The driver may be inexperienced in handling a large truck, which can lead to a fatal accident.
  • The driver turned a corner at too high a speed, which caused the dump truck to experience a rollover.
  • The trucker was distracted by texting, talking on their cell phone or other activities that took their eyes from the road.
  • The driver was speeding, which meant they couldn’t stop in time to avoid a collision with another vehicle.
  • The company employing the driver did not perform regular maintenance on the truck, which led to the fatal accident.

Lawsuits for Wrongful Death

Grief, confusion, and anger are common emotions experienced by a family after losing a loved one in a traffic fatality accident. Often, survivors of wrongful deaths do not consider filing a claim until they face funeral and burial expenses and realize how much of their income is now lost. Filing a wrongful death claim may offer closure to the family members as well as the satisfaction of knowing that the at-fault party is being held accountable for their actions. A wrongful death claim may offer compensation for the following:

  • Funeral and burial expenses that are reasonable
  • An estimate of the deceased’s lost earnings and benefits such as insurance and pension, taking into account their salary until the age of retirement
  • Children are deprived of guidance, care and protection, which can be recovered
  • Loss of consortium and companionship by the surviving spouse
  • Mental anguish due to the death of a loved one

Who Is Eligible to File a Wrongful Death Claim

In California, members of the immediate family may join together to file a claim for wrongful death. The administrator of the deceased’s estate may file. However, only one lawsuit may be brought. The following family members are eligible to file a claim following a wrongful death:

  • The surviving spouse can file a claim for wrongful death.
  • Children of the decedent can join in filing the claim. Children include natural and adopted as well as stepchildren who received half their support from the decedent.
  • If any children of the decedent are deceased, their children can file.
  • If the decedent has no immediate family, the parents and siblings can file.
