What to Know About Filing a Wrongful Death Claim

When a loved one tragically loses their life due to negligence in a Sacramento fatality accident, the family has the right to seek compensation through a wrongful death claim. This right is generally granted to the deceased person’s immediate family, such as their spouse and children, particularly in the Sacramento area. Stepchildren who depended on the deceased for at least 50 percent of their financial support and the executor of the deceased’s estate may also pursue a claim. If immediate family members are not present, parents and siblings of the deceased can file, but only one wrongful death claim is allowed.

Categories of Compensation in a Wrongful Death Claim

Families affected by a wrongful death may seek compensation in the following areas:

  • Funeral and Burial Costs: Covers reasonable expenses for the burial or cremation of the deceased.
  • Support for Children: Addresses the loss of moral support, guidance, and care that the parents would have provided to their children.
  • Loss of Companionship: Provides for the emotional loss of love, affection, and support that close family members experience.
  • Lost Income: Includes lost wages, benefits such as pensions or health insurance, and future earnings the deceased would have contributed over their lifetime.
  • Household Chores: Compensation for the absence of assistance with household tasks, including gardening, vehicle maintenance, tax preparation, and other essential services.
  • Inheritance Losses: Accounts for potential benefits or assets family members would have inherited from the decedent’s estate.
