The pedestrian, whose reasons for being on the freeway remain unknown, was fatally hit by a car that stayed on the scene following the accident. The collision led to significant lane closures. However, the roadway was fully reopened by 7:27 a.m. as the CHP traffic collision unit commenced an investigation to uncover the circumstances surrounding the fatality.

Recovering Compensation in a California Wrongful Death of a Pedestrian

When a Sacramento pedestrian fatality occurs due to someone else’s negligence or wrongful act in California, the surviving family members may be entitled to seek compensation through a wrongful death lawsuit. This legal action aims to financially support the bereaved family and hold the responsible party accountable. Under California law, specific family members are eligible to file a wrongful death claim. These include:

  • The deceased’s spouse or domestic partner
  • Children of the deceased
  • Grandchildren (if the deceased’s children are also deceased)
  • Other dependents who would be entitled to the deceased’s property through intestate succession

Types of Compensation Available

In a wrongful death case involving a Sacramento pedestrian fatality, the following types of damages may be recoverable:

  • Funeral and burial expenses
  • Loss of financial support the deceased would have provided
  • Loss of benefits or gifts the deceased would have given
  • The value of household services the deceased would have performed
  • Loss of love, companionship, comfort, care, and moral support
  • Loss of guidance and training (for minor children)
  • Loss of sexual relations (for a spouse or partner)

The Legal Process to Pursue Compensation

To pursue compensation, the eligible family members or their legal representative must file a wrongful death lawsuit within two years of the date of death. The process typically involves:

  • Gathering evidence to prove the defendant’s negligence or wrongful act caused the pedestrian’s death.
  • Submitting a formal complaint to the appropriate court, outlining the facts of the case and the damages sought.
  • Both sides exchange information and evidence related to the case.
  • Attempts to settle may occur before or during the trial.
  • If a settlement isn’t reached, the case proceeds to trial, where a judge or jury determines the outcome.

While money cannot compensate for the loss of a loved one, recovery of damages from a wrongful death claim can help with financial stability and a sense of justice for the bereaved family.
