Sacramento Pedestrian Fatality Being Investigated to Determine Cause

The crash’s impact prompted a temporary closure of northbound Franklin Boulevard as authorities managed the scene. The driver involved was not suspected of intoxication and stayed at the scene. CHP traffic detectives are actively investigating the cause of the fatal collision.

Understanding the Timeframe for Filing a Wrongful Death Claim

When pursuing a wrongful death claim following the tragic loss of a loved one in a pedestrian accident, it is crucial to file within two years from the date of the incident. Filing after this period will result in the court refusing to hear the claim. A wrongful death attorney can manage the entire process on your behalf, including negotiations with the responsible party’s insurance company. This allows you and your family to focus on grieving and ensure your case is handled with expertise.

Eligibility to File a Wrongful Death Claim

Typically, the wrongful death claim after a Sacramento pedestrian fatality caused by another’s negligence is initiated by the spouse and children of the deceased, as they have the primary rights. In cases where the deceased did not have a spouse or children, the claim could be filed by the parents or siblings. The estate administrator can also file the claim if the deceased left a will. Since only one wrongful death claim is permissible, it is necessary to determine who will benefit from the claim.

Compensation That Can Be Recovered in a California Wrongful Death Claim

In a California wrongful death claim resulting from a Sacramento pedestrian fatality, family members may be entitled to various forms of compensation aimed at easing the financial and emotional burdens following the loss of a loved one. The types of recoverable compensation include:

  • Funeral and Burial Expenses: Memorial services and burial or cremation costs are recovered.
  • Loss of Income: Compensation for the financial support the deceased would have provided is recoverable until their retirement age. In addition, compensation is provided for the decedent’s benefits, such as pension and insurance.
  • Loss of Companionship: Damages for the loss of love, care, and companionship the deceased would have offered can be recovered.
  • Loss of Assistance in the Household: Compensation is recovered for the duties the deceased pedestrian commonly performed around the home because the family will not have to pay someone to handle those chores.
