Pedestrian Fatality Occurs on Business 80 in Sacramento Road Rage Incident
A Sacramento road rage incident on October 19 along Business 80 ended up causing a pedestrian fatality. The accident happened around 8:00 p.m. According to the California Highway Patrol (CHP), a Sacramento man, 47, was weaving through the lanes in a Dodge Ram pickup along Business 80 between Arden Way and the E Street exit. The reckless driver sideswiped a tow truck with a car hauler.
Sacramento Road Rage Incident Occurs Because Pickup Driver Stops
A witness to the road rage crash said the impact between the two vehicles was minor enough that the tow driver may not have been aware of it. Both of the vehicles continued along the highway and did not stop. Near 12th Avenue, the pickup driver stopped in front of the motorist whose vehicle he had struck.
Tow Truck Driver Reportedly Runs Down Other Motorist
The pickup driver then exited his vehicle and confronted the tow truck operator. The tow driver sped up to pass around the pickup and allegedly ran down the Dodge driver. The CHP reported that a witness to the collision stopped to assist the man who had been struck.
Pickup Driver Passes Away at Hospital
Although the pickup driver was conscious and alert at the accident scene, he died as surgery was performed on him at the hospital. The county coroner’s office will not release the driver’s identity of the Dodge pickup until they have notified the family. The CHP in South Sacramento asks anyone with information about the fatal Sacramento road rage incident to call them at (916) 897-5600.
Death of a Pedestrian and Filing a Wrongful Death Claim
The family of a pedestrian who died in an accident caused by another’s negligence or intentional act of wrongful death has the right to file a claim for wrongful death. The immediate family members of a pedestrian killed during a traffic collision, the decedent’s spouse and children, may be helped by a wrongful death lawyer, who can gather the evidence needed to support their claim.
Wrongful Death Evidence Recovery
An injury attorney handling a pedestrian fatality in a traffic collision will send investigators to the accident scene to begin evidence recovery. The police report, witness statement, traffic surveillance video, and accident scene photographs should be gathered. In addition, accident reconstruction may be performed and the police report reviewed.
Damages Recoverable for Wrongful Death
Compensation can be recovered for various losses in a California wrongful death lawsuit, including funeral and burial expenses, wages, and other job perks the deceased would have obtained until retirement. In addition, the spouse may claim loss of consortium, and the children may recover compensation for their loss of parental guidance. Punitive damages may be allowed if an especially egregious or intentional act caused the death of a loved one.
You have limited time to file a claim for wrongful death of two years under California Law if you lost a loved one because of a road rage incident. Without a spouse or children, the parents or siblings may file. Although two years seems like a long time, witnesses and evidence may be difficult to locate during that period, so starting as quickly as possible is advisable.
