Sacramento Taxi Hits Pedestrian

I’m Ed Smith. I’m a Sacramento Pedestrian Accident Lawyer.  On the evening of Monday, December 28, 2015, a pedestrian was struck by a taxi in the downtown area of Sacramento.

5th and Q Streets

The Sacramento Police Department has indicated that the pedestrian was struck down while walking in a marked crosswalk at the intersection of 5th Street and Q Street.

What Happened?

The events leading up to this tragedy are currently under investigation. The driver of the taxi remained present on the scene after the accident. No one has been arrested as of this writing. No additional accident facts available.

Area Under Investigation

Police asked motorists to find different routes of travel while they performed an investigation into the cause of this motor vehicle versus pedestrian accident.

In a different pedestrian accident watch as a mother and her child are hit in a crosswalk by a motorist. Thankfully, they do not appear seriously injured. We noticed that the driver of the car is oblivious to the pedestrians in the crosswalk. We also noted that the crosswalk paint is very faded and needs to be repainted. Apparently, the driver of the black car may have been on his or her phone at the time of this accident. This video reminds us that as pedestrians we must realize that distracted driving is a very real hazard. We must practice defensive walking. Look out for the other guy who may not be paying attention.

Driver of a Motor Vehicle Has Greater Duty of Care than that of the Pedestrian

Although everyone has a duty of care, courts in California have for a long time recognized that the danger posed by a 4000+ pound car is much greater than that posed by a pedestrian. Courts therefore require a much greater duty of care by the driver of the car. (Arentz vs. Blackshere (1967) 248 Cal. App. 2nd 638.
