Detectives with the police department’s significant collision unit investigated the accident, including collecting evidence and searching for witnesses.

Authorities Seek Information From the Public

The deceased pedestrian’s identity is released by the County Coroner’s Office upon notification of the family. Those with information can call (916) 808-5471, the non-emergency number for the Sacramento Police Department.

Who May File a California Wrongful Death Claim?

Immediate families, such as spouses and children, may file a claim for a deceased person. Parents and siblings may be able to file a claim if the deceased did not have a wife or children. Instead, the estate representative may file, but only one lawsuit is possible.

Evidence in Wrongful Death Cases

Evidence that supports the wrongful death in a Sacramento traffic collision is necessary for a successful claim. It must be proven that another person or entity caused the fatality to pursue compensation. Attorneys can conduct a traffic collision investigation to determine whether the family has a valid claim. Documents such as police reports, footage from traffic cameras, witness statements, and other evidence help support the family’s claim.

What Damages Are Recoverable in a Wrongful Death Lawsuit?

California law allows families who lost a loved one due to wrongful death to recover compensation in several ways, including:

  • Burials and funerals can be reimbursed.
  • Benefits such as pensions, insurance, and other financial support, such as wages the deceased provided, can be recouped.
  • Survivors may seek compensation for loss of guidance, advice, love, protection, and moral support.
  • Household services may have been provided by the deceased around the home, such as cleaning or repairs that can be recovered.
  • The family may be entitled to punitive damages if the at-fault person acted maliciously or recklessly, which led to the loved one’s death.
