Vehicles Retained as Evidence Following Sacramento Traffic Fatality
One individual died as a result of the crash, and a chaplain was called. Both vehicles were removed from the traffic fatality scene as evidence. The Sacramento County Coroner’s Office has identified the decedent as 47-year-old Maria Rodriguez Benitez of Sacramento.
Eastbound Florin Road and South Watt were closed down at the intersection while an investigation was conducted by the CHP. The intersection reopened around 7:08 a.m.
Losing a Family Member to a Wrongful Death
Wrongful death claims arise when someone dies due to the negligence of another individual or entity. While any death in a family is tragic and traumatic, it can affect them even more when they realize it never had to happen. To obtain a sense of justice for that loss, the family may wish to file a wrongful death claim with the help of an injury attorney, which holds the at-fault party financially responsible. Although it does not ease the family’s grief, it can help bring them a sense of closure.

What Can Be Recovered in Damages Following a Wrongful Death
Members of the immediate family can join together in a wrongful death claim. The claim can include the following:
- End-of-life expenses, which include the cost of the funeral and burial are included in a wrongful death claim.
- Loss of the support the decedent would have provided until their retirement age is recoverable. Pension and insurance provided to the deceased are recoverable also.
- Loss of inheritance can be recovered.
- Loss of guidance, care, and training of the children in the family is recoverable.
- Loss of consortium, affection, comfort and moral support can be claimed.
- Household services performed by the deceased person can be claimed, which is a monetary value assigned to duties they normally performed, such as car and lawn maintenance or childcare.
- When a death was intentional or egregious, the family may wish to place a claim for punitive damages by filing a survival action. The survival action can be claimed if the decedent didn’t expire right away.
