Sacramento Wheelchair Pedestrian Accident
Those who use wheelchairs or scooters to get around are among the most vulnerable of pedestrians as well as older people, other types of disabled people and children. Because these pedestrians may be harder for a motorist to spot and because they move more slowly, they are often involved in accidents. However, drivers have a duty of care toward others, and when they fail in that duty, they may be held financially liable for any medical care and costs to the injured person incurred in an accident.
Ways in Which a Motorist Exhibits Negligence
Ninety-five percent of all motor vehicle accidents are caused by driver error, and collisions involving pedestrians are no exception. Some of the ways a motorist may cause an accident include:
- Running a red light or traffic sign is a common cause of a wheelchair pedestrian accident.
- Speeding means that a driver may see the pedestrian too late to stop.
- Distracted driving is a major cause of collisions because the motorist is texting, talking on a cell phone or otherwise preoccupied. Any distractions that take the motorist’s eyes from the road and can cause a collision.
- Fatigued driving is less common as a cause of collisions but happens when the driver’s attention is not fully engaged.
- Aggressive driving can include any number of actions such as weaving in and out of traffic, speeding and disobeying traffic laws. Any one of these can lead to a Sacramento wheelchair pedestrian accident.

How a Pedestrian Accident Lawyer Helps
In some cases, a Sacramento wheelchair pedestrian may have been in the street because cut curbs were not available. In other cases, the wheelchair user may have been using a designated crosswalk, but the driver was speeding and could not stop or committing some other traffic infraction. An injury lawyer with experience in Sacramento wheelchair pedestrian accidents can help by investigating the case using forensic expertise and expert witnesses to prove that the driver was at fault for the collision. In this way, medical costs, lost time away from work and other expenses can be recovered for the injured person.
