Details on the Serious Injury Truck Crash on Highway 99 Near Modesto
The California Highway Patrol (CHP) reported that a 47-year-old Newman man was behind the wheel of a big rig headed northbound on SR-99. For unknown reasons, the semi-truck was allegedly involved in a crash with a 2006 BMW. The impact of the collision reportedly propelled the BMW, causing it to veer out of control and off the roadway where it struck a tree.
Crews with the Modesto Fire Department responded to the scene of the big rig crash and utilized hydraulic tools to assist with the extrication of the BMW driver from the vehicle. The BMW driver, a 39-year-old Hanford resident, was transported to Doctors Medical Center in Modesto for treatment of serious injuries. Officials indicated that the injured party stayed in intensive care the following day.
CHP traffic officers are asking for any witnesses to provide information on the truck accident and the sequence of events leading up to it. Additional information on the truck accident on northbound State Route 99 and an update regarding the injured person’s condition were not immediately available.
Importance of Contacting an Attorney After a Big Rig Crash
Big rigs are a common sight on streets and Highway 99 in the Modesto area. These massive vehicles are responsible for the transport of goods up and down California and throughout the nation. State and federal regulations apply to the trucking industry to ensure the safe transport of hauls. Despite these laws, it is not uncommon for truck drivers and trucking companies to violate them. This may occur in the form of driving past the time allowed under Hours of Service (HOS) regulations, falsifying driving or break records, speeding, failure to maintain and inspect the large commercial truck, DUI, and more. When this proves to be the case, any individual injured in a collision caused by the negligence of a trucker or trucking company may take legal action in the form of a bodily injury claim.
Personal injury cases are generally brought against the insurance company representing the truck driver and trucking company in addition to other negligent parties. These are intended to seek financial recovery of damages incurred, such as medical bills, wage loss, pain and suffering, and more. The claims process may be challenging to navigate, particularly in an injury case involving a commercial vehicle. Until you contact a Modesto truck accident lawyer, you may be unsure of how to proceed in your situation. That is why it is best to retain legal counsel immediately after a big rig crash occurs. Time Limits on Personal Injury Cases in California
After a crash involving a big rig, your focus may not be on filing a lawsuit immediately. That is because you may be dealing with mounting medical bills, time away from work, and rebuilding your life after a traumatic injury. You also may be waiting to hear from the insurance adjuster assigned to the claim. Regardless of the situation, it is essential to understand that a two-year statute of limitations generally applies to accident cases, as stated in the California Code of Civil Procedure Section 335.1. Therefore, it is crucial to discuss your case with an experienced attorney immediately and learn which filing deadlines may apply to your claim.
