Pickup Ends up in Orchard off the Roadway in Single-Vehicle Crash

A single-vehicle crash west of Elk Grove resulted in an injury in a January 24 accident when a pickup exited the roadway. The collision happened around 9:45 a.m. along State Route 160 just north of Hood Franklin Road in the Hood area. A report by the California Highway Patrol (CHP) said that a full-size pickup had exited the roadway and gone about 40 feet down into an orchard and experienced a rollover.

Injured Driver Transported to Hospital After Run-off-Road Accident

The individual inside was thought to have suffered minor injuries but was transported by medics to Kaiser South Sacramento Medical Center for additional evaluation. The CHP is conducting an investigation to determine what caused the single-vehicle crash.

Run-Off-Road Accidents: What Causes Them

There are numerous causes of run-off-road accidents, including speeding, distracted driving, bad weather conditions and others. However, there can be circumstances outside the control of the motorist that cause an accident. In such a situation, it may be possible for the injured party to demand fair compensation to cover medical costs, lost wages and their pain and suffering.

Run-off-Road Accidents Caused by Mechanical Failure

Run-off-road accidents are often caused by defects in the tires, steering, brakes or accelerator of a vehicle. The following conditions can lead to this type of accident:

  • Failure of the driver’s power steering can result in the steering wheel locking up, which prevents the driver from controlling the vehicle.
  • A driver who cannot brake can cause a vehicle to run off the road if the car cannot be slowed down.
  • Tire blowouts or tread separation can cause a driver to lose control, resulting in a vehicle going off the road.
  • In the event of engine failure, the driver has no control over what is happening.

Filing an Auto Product Liability Claim

A personal injury lawyer can help you file an auto product liability lawsuit if a defect causes an accident. Because of this, it is essential to prevent the vehicle from being destroyed after an accident, so engineers can examine it for defects. In filing an auto product liability claim against the manufacturer, parts designer and others in the production line, negligence does not have to be proved. The only requirement is to show that the part/product was used as it was intended and remained unaltered.

Negligence by the Government

There are many factors that can lead to a run-off-road accident, including potholes, fissures, breaks in the pavement, and poor road design. It is possible to hold the government entity responsible for injuries caused by their design and maintenance. When a government entity is involved, however, the statute of limitations for filing a claim is much shorter, so consulting an attorney can be beneficial. An attorney can ensure that all documentation is completed correctly and that the claim is filed before the statute of limitations expires. Unless this is done, the case cannot be heard in court.

When to Call an Injury Lawyer

Taking advantage of a free, no-obligation consultation with an injury lawyer may be beneficial if you think your run-off-road accident was caused by an outside force and you suffered injuries. Many claims of this type have been successfully handled by my law firm over the years.
