Investigators Determining Cause of Single-Vehicle Fatality Crash
Investigators are going over evidence at the scene to determine if there were other passengers in the motor vehicle and what caused the crash. No additional information has been released about the individual who died in the crash, pending notification of family members by the coroner’s office. The roadway was shut down while an investigation ensued, and motorists were warned to stay away from the area while the investigators worked.
Losing a Loved One in a Single-Vehicle Fatality
The death of a loved one is difficult for most families, however, losing them because of negligence is overwhelming. The family reacts with grief over their loss and anger that it happened. Most people believe that a single-vehicle crash is due to driver error, but that is not always the case. Families owe it to themselves to find out why the accident occurred since not knowing is even harder to deal with in the long run.
Why Does a Single-Vehicle Fatality Occur?
Aside from driver error, there are additional reasons for a single-vehicle fatality. They are listed below:
- The driver tried to avoid another vehicle that was heading toward them. At an intersection, this is common since motorists disobey signage or lights that warn them to stop. Our investigators obtain surveillance video to see what happened in the intersection.
- The driver’s brakes are faulty. This makes it impossible for them to slow down or stop in time to avoid a single-vehicle fatality accident. When this happens, the deceased’s family can file a wrongful death lawsuit against the brake or the automotive manufacturer. This is called a product liability lawsuit within the wrongful death claim.
- The tires on the vehicle may be defective, and the family of the deceased has the right to hold the manufacturer liable once again. In California, it is unnecessary to prove negligence in a product liability lawsuit. It is only required that the product was used as was originally intended and without modification.
- Sometimes, a hit-and-run motorist causes the driver to swerve in order to avoid an accident much like what happens when someone runs a red light. The only thing is the motorist who flees must be located to file a lawsuit against them. However, if the person or a member of their family has uninsured/underinsured insurance, it can be used to recover damages.
