Investigation Being Conducted to Determine Cause of South Sacramento Vehicle Crash
Authorities do not believe that drugs or alcohol were involved. Inherent Benefits of Wrongful Death Lawsuits for Families
The family of a deceased pedestrian can file a wrongful death lawsuit against the person who was negligent or intentionally caused the death after a fatal pedestrian accident in a South Sacramento vehicle crash. Surviving family members of the deceased can benefit from a wrongful death lawsuit in several ways:
- Expenses and losses caused by the death: In a wrongful death lawsuit, expenses associated with the death can be recovered, such as funeral and burial expenses, lost wages until the decedent’s retirement age, and pain and suffering. Other damages that may be recovered include the loss of household assistance, loss of consortium for the remaining spouse, and lost inheritance.
- Justice: The sense of justice that comes with knowing that the negligent driver is being held responsible for your loved one’s loss of life can bring peace of mind to your family members. Additionally, it can provide closure and help them move on.
- Avoidance of financial hardship: In many cases, the loved one who died helped financially support the family. By losing them, the family no longer has that income and often suffers financial strain, including paying for the funeral and burial. By filing a wrongful death claim, the family can avoid that stress.
Staying Within the Statute of Limitations
In California, the statute of limitations to file a personal injury or wrongful death claim is two years. If the claim is filed after two years, the court will refuse to hear it.
Coverage for Uninsured/Underinsured Motorists
As an add-on, California auto insurance policies offer coverage for uninsured/underinsured drivers. Many drivers take advantage of this offer since there are so many in the state that cause a South Sacramento vehicle crash. This add-on policy benefits people injured while walking, riding a bike, or driving. In addition, it can be used if the accident involves a hit-and-run and the driver cannot be located. Any immediate injured party’s family member with insurance can be used. There is no change in the policy rates.
