Fatal Accident Reported on Elverta Road Involving Single Vehicle
Speeding was a factor in the cause of an accident fatality that killed one man and injured another in Elverta on October 27. The report on the accident issued by the California Highway Patrol (CHP) stated that the crash happened along Elverta Road in the area of Gibson Ranch and the Cherry Island Golf Course sometime after 2:00 in the morning. The CHP said the truck driver was going at a “high rate of speed” when he apparently lost control of the vehicle, struck the gravel on the shoulder, and crashed into a pole.

The Loss of a Loved One as an Accident Fatality
Families are grief-stricken when a loved one is lost, but even more so when it was due to an accident fatality caused by someone else’s negligence. Family members are not only thrown into deep grief, they are confused and angry, wondering why it had to happen. When negligence is involved, the at-fault party may face criminal charges because of the accident fatality, but the family can also place a wrongful death claim to recover financial damages for their loss.
Although filing a wrongful death claim following an accident fatality will not lessen the family’s grief, it can help by bringing a sense of justice and closure. The following can be recovered by filing a wrongful death lawsuit:
- The cost of the funeral and burial can be claimed in a wrongful death lawsuit.
- The wages the deceased would have earned at their job until the age of retirement is recoverable, including bonuses or additional perks of the employment.
- Loss of inheritance can be recovered.
- The spouse can recover financial damages for the loss of consortium, affection, and moral support the decedent provided.
- Minors in the family, including stepchildren who obtained at least half of their support from the decedent, can recover damages for the loss of guidance and parental care.
Investigating the Accident
By conducting an investigation into the accident fatality, evidence can be gathered to support a client’s claim if negligence was involved. Some of the areas where our investigators gather evidence include performing accident reconstruction, reviewing the police report for mistakes, and interviewing witnesses. In addition, traffic surveillance cameras in the area are examined to see if they captured the speeding accident on film.
