Wrongful Death Cases Involving Minors in California

When a minor passes away in a Stanislaus County fatal accident due to the negligence or wrongful actions of another party, the surviving family members may pursue a wrongful death claim to seek justice and compensation. These cases are particularly sensitive due to the young age of the deceased minor and the emotional toll on the family.

Under California law, specific individuals, such as parents or legal guardians, are eligible to file a wrongful death lawsuit on behalf of the deceased minor. If the parent had a registered domestic partner or putative spouse, they may join the claim. These claims can cover damages such as medical bills, funeral expenses, loss of companionship, future earnings and benefits, and emotional distress. Every case is unique, and the compensation awarded often depends on the specific circumstances surrounding the incident.
