State Route 20 Car Accident Proves Fatal
A fatal car accident occurred east of Marysville on June 18 when the driver’s vehicle struck a tree. The crash occurred along State Route 20 at Sicard Flat Road around 9:36 a.m. Tire marks were found on the roadway by officers with the California Highway Patrol (CHP) and the Yuba County Sheriff’s Office. No debris was present in the road.
Investigation Being Conducted to Determine Cause of Fatal Car Accident
A tow truck was called to remove the vehicle. The County Coroner was notified of the fatality, however, the identity of the deceased driver will not be released until the surviving family members have been notified. An investigation is being conducted by the CHP traffic accident unit to determine why the driver lost control and crashed.
What Is the Importance of Tire Tracks at an Accident Scene?
Tire marks don’t necessarily prove the cause of a fatal car crash, but they can provide evidence. For example:
- A lack of tire marks may mean the driver fell asleep at the wheel, was distracted or was impaired.
- If tire marks cross over into another lane, the brakes might have failed or a tire blew out.
- Short tire marks might mean the driver tried to stop and failed. This might occur if the driver was distracted or an animal or other obstacle was in the roadway.
- Curved or wavy tire marks might indicate a broadside collision or fishtailing, both of which can lead to a fatal car accident.
A Claim for Wrongful Death Compensation
When a family member dies in a fatal car accident due to unknown factors, an injury lawyer can investigate to determine the cause. If negligence by another individual or entity was involved, the immediate family members (surviving spouse and children) may want to find out about filing a wrongful death claim to recover damages. Although their grief will not be alleviated, it can hold the at-fault party responsible and help give them a sense of justice for their loss.
How Reckless Driving Causes a Car Accident
Reckless driving is a serious traffic violation that can cause severe consequences, including a fatal car accident. When individuals drive recklessly, they put themselves and other drivers at risk of being involved in an accident due to their negligence and disregard for safety standards set by the law. Reckless driving includes but is not limited to speeding, running red lights or stop signs, weaving between lanes of traffic, failing to yield to the right-of-way and even engaging in drag racing. All of these behaviors are dangerous because they can cause serious injuries or fatalities if an accident occurs.
Wrongful Death Claims
Typically, wrongful death claims can recover the following damages:
- Wages the deceased would have earned up until their normal retirement age, including pension and insurance benefits, bonuses and others
- Companionship, consortium, affection and emotional support are lost to the spouse, who may claim compensation
- Funeral and burial expenses are recoverable
- The family’s children may claim compensation for their loss of parental affection, nurturing and guidance
- As a result of the loss of household services by the family, such as lawn and car care and others, the cost to pay for such work can be compensated
