Pursuing Compensation for Fatal Accidents

When a loved one dies in a Stockton fatal pedestrian accident caused by a negligent driver, immediate family members might be able to file a claim for wrongful death. This legal action helps seek compensation for their loss and holds the responsible party accountable. An experienced accident attorney can assist in identifying the liable party and establishing how their negligence led to the fatality.

The deceased person’s spouse and children are the primary individuals who may file the claim. However, in the absence of a spouse or children, close relatives such as parents or siblings may also pursue the claim.

Recoverable Damages in a Wrongful Death Case

In a wrongful death case involving a Stockton fatal pedestrian accident, the following types of compensation may be pursued:

  • Loss of household assistance provided by the deceased

  • Loss of consortium, love, and affection for the surviving spouse
  • Wages the deceased would have earned until their anticipated retirement age

Proving Fault in Accidents Causing Injuries or Death

In Stockton, most claims related to injuries or fatalities from accidents caused by another party’s negligence are resolved through the at-fault party’s insurance provider. To pursue a wrongful death lawsuit after a Stockton fatal pedestrian accident, it is critical to establish that another individual’s negligent or reckless behavior directly contributed to the car accident. Attorneys are crucial in investigating the circumstances and compiling evidence to bolster the case. Commonly utilized evidence includes accident reconstructions, witness statements, surveillance footage, vehicle and roadway damage assessments, and police reports.
