Collecting Evidence After a Fatal Accident

To support a family’s wrongful death claim following a fatal Stockton T-bone accident, a thorough investigation is essential. Our team follows these steps to gather comprehensive evidence:

  • Reviewing the police report: Carefully examining the police report ensures that errors do not adversely affect the client’s compensation claim. Corrections can be made if discrepancies are found.
  • Performing accident reconstruction: By reconstructing the accident, we can determine the precise points of collision. Diagrams illustrating vehicle positions before, during, and after the crash are used by both civil courts and insurance companies to identify the responsible party.
  • Looking for video surveillance: It is crucial to check for available traffic camera footage in the area. If video evidence exists, it can be subpoenaed to support the investigation.
  • Interviewing witnesses: Witnesses are interviewed to gather corroborating statements about the collision’s causes. Some witnesses may have recorded the accident on their cell phones, offering additional valuable evidence.

Filing a Claim for Wrongful Death

A fatal Stockton T-bone accident may lead a family to seek justice and mitigate financial hardship by filing a wrongful death claim. Immediate family members, such as a spouse or children, are eligible to recover compensation. Failing the existence of a spouse and children, the decedent’s parents and siblings may file. The deceased person’s estate may also be filed; however, only one lawsuit is allowed.

Compensation in a Wrongful Death Claim

The amount of compensation awarded in a wrongful death claim varies based on the circumstances of the accident and the damages. Recoverable damages include funeral expenses, pain and suffering, lost wages of the deceased, and loss of consortium and household assistance. Additionally, punitive damages may be awarded to penalize the defendant’s negligent actions if they were intentional or especially egregious. If the deceased survived for a period before passing away, a survival action could be filed to recover medical expenses and compensation for their pain and suffering.

An injury lawyer can significantly ease the burden on a grieving family by handling the legal aspects of the case. This support allows the family to mourn without the added stress of financial concerns following the death. Furthermore, experienced legal counsel can help families achieve a sense of closure and ensure that justice is served in their loved one’s case.
