Suisun Fatal DUI Trial Delayed

I’m Ed Smith, a Suisun personal injury lawyer. On Thursday, May 25, 2017, the suspect of a hit-and-run trial that occurred in Suisun agreed to delay a jury trial in hopes of the possibility of negotiating a successful plea deal.

The suspect faces a charge of gross vehicular manslaughter, a felony charge of hit-and-run, two felony charges of DUI, and a charge of driving on the incorrect side of the roadway, leading to an injury accident. The 20-year-old resident of Fairfield was ordered to return to court on Tuesday, July 13, 2017.

What Happened?

According to reports from officers of the Suisun City Police Department, the collision occurred on July 9, 2016, at around 4:50 in the morning near the intersection of Railroad Avenue and Sunset Avenue. The driver of the vehicle had been driving recklessly when he struck a 57-year-old man who had been out collecting cans on his bicycle.

Officers reported that they found the bicyclist next to the vehicle that had struck him and that the driver had left the site of the accident on foot and was found walking away from the area and covered in mud and water from an irrigation canal. Prosecutors have indicated that the blood-alcohol level of the driver had been at 0.14 percent when he was found by officers.

Emergency Medical Response

Emergency medical responders found the man with serious traumatic injuries and reported that, when he was found, the man had no pulse. The bicyclist was transported to the nearest hospital and given treatment for his injuries. However, the man’s injuries were ultimately too severe and he eventually lost his life in the hospital six days after he was struck by the vehicle.

Drunk Driving Accidents

Driving under the influence of alcohol severely reduces a driver’s ability to avoid serious accidents and often leads to critical injuries and fatalities. Impaired judgment from the use of alcohol renders drivers more likely to make unsafe decisions while operating their vehicles and also makes it more difficult for drivers to respond to dangerous roadway conditions.

Almost as many as one-third of all fatality accidents in the United States are caused by drivers who are under the influence of alcohol and/or drugs and, according to the National Highway Traffic Safety Administration (NHTSA), the likelihood that a person living in the U.S. will be involved in a DUI accident over the course of their life is one in three.
