Eligibility to File a Wrongful Death Claim

When a loved one dies due to someone else’s negligence or carelessness in a collision, certain family members are eligible to file a wrongful death claim. Specifically, immediate family members like a spouse or children can seek compensation. This compensation may cover the decedent’s lost wages and bonuses up until their retirement age, along with funeral and burial expenses. A surviving spouse can also claim damages for loss of consortium and affection, while children may also seek compensation.

In cases where the deceased had no spouse or children in the Susanville accident with a fatality, parents and siblings are allowed to file the claim. Consulting with an accident attorney is recommended for detailed guidance on recoverable damages. The accident lawyer can calculate the damages for you.
