Filing a Wrongful Death Claim After an Accident Fatality

If a negligent driver caused the death of your loved one, the family may file a wrongful death claim to recover compensation. Generally, this right is granted to the decedent’s immediate family, which includes the spouse and children following a Sacramento fatal accident. Stepchildren who were financially supported by the deceased by at least 50 percent and the executor of the estate also have the right to file. In cases with no immediate family members, the deceased’s parents and siblings may be entitled to file a claim, yet only one claim is still permitted.

Damages That Can Be Recovered in a Wrongful Death Claim

The damages recoverable in a wrongful death claim vary and largely depend on the deceased’s earning potential and age in the Sacramento fatal accident. Families may seek compensation in various categories, including:

  • Lost wages, benefits such as insurance and pension, and potential earnings over the deceased’s expected working lifespan.
  • Funeral and burial expenses.
  • Loss of love, affection, and spousal consortium for the bereaved spouse.
  • Loss of nurturing, moral support, and guidance to children.
  • Potential inheritance losses that beneficiaries in the decedent’s will might claim.
  • Lost household assistance for the decedent’s duties, including lawn care, gardening, auto maintenance, tax preparation and others.
