Two People Killed in Accident Involving Big Rigs

An early morning collision between three big rigs and a pickup truck resulted in two fatalities along State Route 99 on January 28. The California Highway Patrol (CHP) reported that the accident happened around 6:57 a.m. in Galt, north of the Ayers Lane exit ramp. Two people were killed in the crash. They are identified as Charlie Mosqueda, 20, and Jose Antonio Rincon-Mosqueda, 33, both residents of Galt. Antonio Mosqueda is survived by his wife and Charley Mosqueda is survived by his parents. The accident blocked all the northbound lanes of the highway, causing heavy traffic congestion. One of the big rigs involved was a FedEx delivery truck. Officers with the Galt Police Department and emergency responders with the Sacramento Fire Department arrived at the accident site. A SigAlert was issued, warning motorists to find alternate routes of travel. Tow trucks were called to remove the vehicles. The roadway reopened around 11:00 a.m. The accident is under investigation to determine how it happened and to assign fault.

Accidents Involving Big Rigs Becoming More Common

In California, which requires big rigs to deliver products and goods up and down the state, truck accidents are becoming more common. In 2018, 4,136 individuals died as a result of an accident that involved a big rig. Delivery trucks such as FedEx and Amazon are becoming an increasing problem due to the pressure placed on drivers to make deliveries faster. When you are injured in an accident that involves a big rig, it is important for you to engage the help of an experienced lawyer. Recovery of damages for your injury means that you will be paid for the time you lost from work, be able to cover all your present and future medical bills, and be reimbursed for your pain and suffering.

Truck Accidents Can Be Complicated

An accident that involves big rigs requires different investigative techniques than one involving other motor vehicles. This is because the drivers of big trucks, as well as the companies that employ them, operate under a different set of rules. For example, the driver of a big truck is limited in the number of hours they can be on the roadway and is obligated to take rest breaks and recheck the load along the way. Failure to comply is illegal and can prove negligence in an accident. In addition, the driver may be texting, speeding, under the influence of drugs or other illegal actions that would make them liable for an accident.

How a Lawyer Helps

Investigation and the collection of evidence makes a difference in whether an injury claim will be successful. We send our investigative team out to the accident site right away to gather important evidence to build a strong case. To start, they review the police report and interview the witnesses. Following this, they look for traffic and business cameras that might have recorded the crash and perform accident reconstruction. Reconstructing the accident shows the original positions of the vehicles, the way they moved forward, and the position they ended up in. The investigators also comb the driving records of those involved, look for previous infractions committed by the truck drivers, and pore over the logs looking for false entries. When the evidence is gathered, it is given to our lawyers to build a strong case for our client to recover damages, either from the insurance company or through a lawsuit in court.
