What is a Bodily Injury Claim?
After an individual is injured in a traffic crash caused by another party, they may seek reimbursement for their injuries and losses through a bodily injury claim. The purpose of this type of case is to consider what the claimant has lost because of the incident and to make them whole again. The compensation is divided into economic and non-economic damages. This may include payment for lost earnings, wage loss, pain and suffering, and other damages. In situations where there is limited insurance or no liability coverage, an injured individual may have other options for recovery, such as UM/UIM coverage.
To collect compensation in a personal injury claim for a car accident, it must be established through clear evidence that the other side was liable for the incident. For instance, a claimant may be able to establish the other party’s negligence by demonstrating that they were not following the rules of the road when the incident occurred. This may include speeding, running a stop sign or traffic light, following too closely, DUI, and more. From there, it must be proven through compelling evidence that the injuries resulted from the crash and not from another cause.
Once it has been established that the other side was responsible for the car wreck and causation for accident-related injuries, an injured party may seek compensation for economic and non-economic damages associated with the crash. This may include the costs of replacing or repairing property that was damaged in the collision, including a vehicle, lost earnings for missing work from accident-related injuries, costs of treatment for injuries, future medical treatment, costs of home renovations to accommodate a permanent injury or disability, and other losses.
