Top Reasons Roadway Accidents Happen

I’m Ed Smith, a Roseville personal injury lawyer. Negligence while driving is a problem nationwide and contributes to many motor vehicle accidents. Although Roseville is a fairly tranquil place with a low rate of accident injuries and deaths, Interstate 80 and Route 65 are roads where negligent drivers cause collisions.

2016 Speeding Statistics

Crash data for 2016 has been released by the National Highway Traffic Safety Administration that illustrates how serious a problem distracted driving is.  According to the Centers for Disease Control and Prevention, distracted drivers are a factor in 1,000 accident injuries each day as well as 9 deaths.

  • Fatalities with speeding as a factor in an accident went up by 4 percent over 2015, causing 10,111 deaths, while other factors such as drowsy driving and distracted driving decreased.
  • Distracted drivers decreased 2.2 percent, causing 3,450 accident fatalities.
  • Drowsy drivers decreased 3.5 percent, causing 803 accident deaths. The National Sleep Foundation reports that 13 percent of the people they surveyed admitted they fell asleep at the wheel at least one time every month.
  • Drunk drivers continue to be a problem with 10,497 fatalities, an increase of 1.7 percent over the previous year.
  • Fewer people were wearing seat restraints in 2016. This contributed to a 4.6 percent increase in accident fatalities, raising the number of deaths to 10,428. A study by Consumer Reports says that seat belt use by back seat passengers is lower that that for those riding in the front seat. It cautions that not wearing a seat belt in the back seat increases the risk of death in a collision by three times.

Injuries Caused by Distracted Drivers

Like other accidents, distracted driver accidents can result in wrongful death or leave accident victims with significant injuries. These may include fractured bones and lacerations or traumatic injuries such as spinal cord damage, brain injuries or even the amputation of a limb. Contacting an experienced injury lawyer can be a good decision. A lawyer seasoned in this type of accident can help recover fair compensation.

Comparative Fault

California recognizes pure comparative fault. This is important since an accident might not be caused by only one party. For instance, a distracted pedestrian or bicyclist might move into the road oblivious that the “Do Not Walk” sign is flashing. In such cases, the pedestrian or cyclist is partly at fault for an accident if a motorist who has the right of way hits them. Both parties may share fault equally. The damages will be divided equally too with both responsible for half of the total damages.
