Can You Seek Compensation for Injuries From a Tractor Accident?
If an individual was injured while riding on a farm tractor, backhoe, or other heavy machinery, the right to file a claim for damages will depend on how the incident occurred. When another party or entity caused the tractor accident through negligence and the individual has sustained injuries due to the accident, they may have the right to seek compensation for non-economic and economic damages. To establish negligence, an attorney must prove that the defendant owed the injured party a duty of care, they breached the duty of care, the breach was the direct cause of the incident, and that damages occurred.
The amount of compensation an injured party may be entitled to will depend on various factors. These may include the injured individual’s age, the severity of physical injuries suffered in the tractor accident, work history, educational background, and future consequences of accident-related injuries. Eligible claimants may be compensated for medical expenses, wage loss, loss of enjoyment of life, pain and suffering, and other losses associated with the crash. There must be clear and compelling evidence demonstrating the cause of injuries and their impact on the claimant’s life.
When a farming accident occurs, the farm owner may be held liable for damages. This may be due to the failure to implement safety measures to keep others out of harm’s way. If the tractor accident is believed to have occurred because of faulty equipment, an injured party may have grounds for a products liability lawsuit against the manufacturer. The farm machinery must be kept and preserved until a California accident attorney and their team of experts have examined it for insufficient consumer warning for incorrect use or potential hazards, manufacturing defects, and faulty designs.
