Compensation With the Driver Is at Fault
When a motorist is negligent and causes a Tracy off-road accident, it can result in severe trauma or fatalities. When negligence by the driver causes a collision, those who were injured can hold the motorist responsible for their injuries and other losses. If someone dies as a result of a negligent driver, they can be held legally responsible by the decedent’s family.
Recoverable Damages in a Personal Injury or Wrongful Death Claim
When someone suffers injuries caused by the negligent driver they were riding with, they may recover all of their medical expenses and lost wages. They may also receive compensation for their pain and suffering. The family, usually the spouse and children of someone who died as the result of a negligent driver, may file a wrongful death claim to recover compensation. Damage recovery for a wrongful death includes the funeral/burial cost, wages until the decedent would have reached retirement age and compensation for the spouse and children for their suffering.
Assistance from an Accident Attorney
An accident attorney can review your case at no charge to see whether you can file a claim. If you can, the lawyer will use an investigator to collect the evidence that supports your claim. Once the evidence is compiled, the lawyer will use it to construct a strong case. Then, the lawyer will conduct negotiations on your behalf with the at-fault driver’s insurance company. Around 95 percent of all claims are settled in that way. However, if the negotiations fail or the insurance company does not want to pay the amount you or your family are entitled to, the case can be taken to civil court for resolution.
