She was transported by medical personnel to a local hospital for treatment of unspecified injuries. An update regarding her condition was not immediately available.
Common Reasons for Rollover Accidents
The most dangerous car accidents are those involving rollovers. This is due to occupants within the vehicle being susceptible to striking the inside of the car. Airbags only deploy once, and seat belts may sometimes fail. This can further increase the risk of injury. Some of the common reasons for these crashes include tripping when the motion of a car becomes interrupted from crashing into an object in the road, guardrail or soft shoulder. Conversely, lack of roadway maintenance and a defective tire or blowout may also be to blame for these accidents.
Common Injuries in a Rollover Accident
Rollover accidents can have traumatic consequences for motorists and passengers alike. Along with high property damage to the car, occupants within the vehicle at the time of the rollover may suffer lasting, debilitating injuries. Those involved in these car wrecks may be severely traumatized by the incident and suffer mental anguish. In other cases, a rollover can leave a party with a cervical sprain, broken bones, traumatic brain injury, internal trauma, and spinal cord injury. Moreover, the emotional, physical, and mental trauma of these crashes can be extremely challenging to overcome. If the collision was caused by the fault of someone else, the injured person might be able to seek compensation for their injuries and other damages.
What Damages May Be Recovered in an Auto Accident?
To recover compensation in a personal injury case, evidence must be proven that the negligence of another party was responsible for your injuries. In some rollover accidents, there may be more than one party liable for your losses. These may include:
- The Motorist: If you are a passenger at the time of a rollover accident and it only involved the vehicle you were riding in, you might be able to file a claim against the driver for your damages.
- Other Vehicles: Rollover accidents are sometimes caused by drivers of other cars who are not paying attention to the road, make sudden stops, or run you off the road. Any of these instances can cause you to lose control of your car leading to a rollover.
- Auto Manufacturer: There are times when faulty vehicle parts or equipment cause a rollover accident. The auto manufacturer may be found responsible for poor vehicle design that is susceptible to overturning and causing injury. These are common among SUVs, 15-passenger vans, and light pickup trucks due to their higher centers of gravities.
- Government Entity: Road defects are often attributed to rollovers. These may include inadequate road warning signage, potholes, poorly designed merge lanes, and hazardous road construction debris. In these situations, compensation may be sought from the government entity responsible for maintaining the road for which the crash occurred on.
Benefits of Hiring a Tracy Personal Injury Attorney
When seeking compensation for your injuries, you may face many roadblocks. This is often due to insurance companies often delaying or denying to provide reimbursement for your personal injury case. In other cases, they may offer you extremely low settlement offers. It is also possible that the party responsible for the accident and their insurer will dispute or refuse liability. This can force you to provide facts and evidence for your case. Having a Tracy personal injury attorney who is experienced in handling rollover accident claims is crucial. An experienced attorney will investigate further into the collision and communicate effectively with insurance companies to reach a fair settlement. This way, you can focus on recovering from your injuries without the worry of filing legal paperwork and meeting deadlines.
