Negligence and Traffic Collisions
Negligence by a driver or other entity is almost always responsible for a traffic collision. Some of the types of negligence exhibited by a motorist include:
- Tailgating: Tailgating another vehicle means that if the car in front slows down suddenly, the driver behind may be unable to stop in time to avoid a crash.
- Distracted driving: Texting, talking on a cell phone, eating or drinking while driving, and other distractions can all lead to a traffic accident.
- Drunk driving: Drunk or drugged drivers weave in their lanes, cannot judge their distance from other vehicles and other serious problems.
- Fatigue: A driver who is overly tired has been shown in studies to be similar to someone who is inebriated in their inability to drive safely.
- Red-light runner: A motorist who runs a red light or stop sign is common in intersection accidents.
Conducting an Investigation Into a Traffic Accident
In any accident that involves an injured party wanting to claim damages from an at-fault motorist or entity, an investigation has to be conducted to gather the evidence. When more than two vehicles are involved, several drivers may be at fault. Our investigators are able to do just that by performing the following:
- The investigators go over the police report to ensure it is accurate. Any mistakes can mean the injured client may not be able to place a compensation claim.
- Forensic reconstruction is performed. This type of investigation demonstrates how the collision occurred and often points toward the at-fault party/parties.
- Witnesses of the traffic accident are interviewed by the investigators. They can not only provide corroborating statements but may have filmed the accident as it happened on their cell phones.
- A check is made of negligent behaviors by the other drivers, such as distracted or drunk driving, speeding, and others.
- Area surveillance cameras are examined to see if the accident was captured on tape.
When the evidence has been compiled, it is turned over to our injury lawyers. They use this evidence to build a compensation claim for our client.
