Marysville Cyclist Faces Trial
A man who has been accused of fatally striking Michael Cesspooch, a 53-year-old cyclist from Marysville, with his pickup truck will soon be facing trial for his charges.
The Accident
Officers of the Oroville Police Department (OPD) have accused Anthony Abuanbar, a 38-year-old Oroville resident, of fatally striking Cesspooch while driving his vehicle southbound on Feather River Boulevard a short distance north of the intersection at Oro Dam Boulevard at around 8:30 p.m. on September 12, 2017.
Officers reported that Cesspooch’s bike was stuck under Abuanbar’s truck after the accident and that Abuanbar had been seen dragging Cesspooch’s bicycle a short distance before he eventually pulled over to the side of the road in an alleged effort to conceal the evidence of the fatal accident.
Police later arrested Abuanbar after pursuing him to the Pacific Heights Road Area. He was arrested on charges of hit-and-run driving resulting in fatal injuries, gross vehicular manslaughter, and fleeing a pursuing police vehicle while recklessly driving.
A Bargain Rejected
Abuanbar has pleaded not guilty to all charges. However, on Thursday, November 30, 2017, prosecutors offered the defendant a bargain that would have let Abuanbar plead guilty to reduced charges of evading police, DUI vehicular manslaughter without gross negligence, and enhancement of leaving the scene of the accident. The deal also provided that Abuanbar would spend an upper-limit prison sentence of nine years and eight months.
After Abuanbar spoke with his legal counsel, he reportedly rejected the deal and will be standing trial for his full charges on December 11, 2017. The trial will be presided over by Judge Clare Keithley. If convicted of all charges, Abuanbar will face up to 16 years and eight months of prison time.
At this time, Abuanbar remains in the custody of Butte County Jail.
