Two Injured in Merced Multi-Vehicle Crash
Two parties were injured in a Merced multi-vehicle crash on the morning of June 4, 2019. The car wreck occurred shortly before 10:50 a.m. at the intersection of G Street and Foothill Drive. A Chevrolet 3500 pickup truck was headed south on G Street and reportedly ran a red light. The Chevrolet then crashed into a BMW 3 series that was turning left from Foothill Drive onto G Street. The impact of the collision propelled the BMW across the road and caused it to crash into a Toyota Camry that was stopped at the intersection. Emergency crews were called to the scene to extricate the motorist out of the mangled BMW. Officials said the BMW driver was transported via air ambulance to the hospital for treatment of back and neck injuries while the Chevrolet driver was taken to the hospital for treatment of severe hand lacerations. Officials have not yet released an update regarding the conditions of those injured in the car accident.
Proving Fault in a Merced Multi-Vehicle Crash
A driver will often be liable in an accident due to carelessness or negligence behind the wheel. Following are the types of car wrecks that may constitute a personal injury claim:
- Driving on the wrong side of the road
- Driving under the influence of alcohol or drugs
- Driving while distracted by talking or texting on a cell phone, applying makeup, or other forms of distraction
- Failing to yield the right of way to other drivers
- Following too closely
- Reckless driving such as running a stop sign or traffic light
- Speeding or driving too fast for weather or traffic conditions
- Unsafe lane changes
What Can Be Recovered in a Personal Injury Case?
When a person suffers a personal injury in a car wreck, they can incur a substantial amount of economic and noneconomic losses. Compensation in a personal injury claim will not only cover medical expenses but also lost wages, loss of earning capacity, loss of consortium, property damage, and pain and suffering. To know whether a person is eligible to pursue financial compensation following a collision, it must be determined whether another party was at fault in the crash. In other words, it must be proven that the negligence of someone else caused the resulting injuries.
Statute of Limitations for a California Personal Injury Claim
The statute of limitations outlines the amount of time an individual has to file a claim for damages in Merced or throughout California. For cases of personal injury, a claim must be filed within two years from the date of the incident. If government negligence is involved in the case, the injured person must file a notice within six months or 180 days from the date of loss. Failing to bring a claim within the statutory period will result in the inability to claim compensation. For details on whether a personal injury claim is worth pursuing, watch the below video.
