What to Expect From a Wrongful Death Motorcycle Accident Case

Under California law, a loss of life is considered to be wrongful death when it occurs as a result of another party or entity’s negligence. The decedent’s family may recover damages associated with the loss of life from the party who caused the fatal incident. A wrongful death claim must be settled with the other side or filed in civil court within a specific time limit known as the statute of limitations. Under CCP 335.1, there is a two-year deadline for these matters. It may be shortened to 180 days if the case names a public agency a defendant, according to California Government Code Section 911.2.

Every case of wrongful death is unique. Therefore, the value of non-economic and economic damages may differ from case to case. In these matters, an experienced accident attorney will evaluate various factors. These may include the decedent’s age, life expectancy, history of earnings, future earning potential, education, etc. The lawyer will also review any out-of-pocket expenses incurred by survivors, the nature of the other side’s actions, the extent of surviving family members’ financial dependence on the decedent, circumstances surrounding the loss of life, and more.

Not just any relative may file a claim for wrongful death in California. Under CCP 377.60, family members that have priority for recovering damages in these cases include the spouse, domestic partner, or children. If there are no surviving children, domestic partner, or spouse, the surviving parent or parents may be eligible for filing.
