Reasons for a Rollover Accident
Losing control of a vehicle is the most common cause of a rollover and can be caused by speeding, distracted driving, fatigue, or alcohol/drug consumption. However, not all rollovers occur due to errors on the part of the driver. Other causes of a rollover include:
- Aggressive driver: An aggressive driver can tailgate, cut in and out of traffic, or force another driver off the road.
- Defect in the motor vehicle: A vehicle with defects in the brakes, steering, or accelerator could be involved in an accident, including a rollover. In cases such as these, the manufacturer, designer, seller, or parts supplier might be held responsible through a product liability lawsuit.
- Neglect in road maintenance: Poor road maintenance can cause many problems for drivers, including soft shoulders, debris on the roadway, and overgrown signs. Any of these problems could help contribute to a rollover accident. The government entity responsible for the upkeep of a roadway may be held responsible. However, the statute of limitations for filing against a government entity is much shorter than most personal injuries. Enlisting the help of an experienced attorney can ensure that all paperwork is filed on time and handled correctly.
- Crushed roof: Rollover injuries are often due to weak roof strength. This lack of roof protection can lead to serious head trauma and spinal damage.
Seeking Help From a Lawyer Following an Accident Injury
Accidents can be complicated when it comes to finding what caused the collision and what type of negligence was involved. This is why it is a good idea to consult with an experienced personal injury lawyer. We send out investigators to the crash scene right away to uncover the evidence that can be used to establish fault. Our investigators review the police report for errors and talk to any witnesses. They may perform accident reconstruction and will search for video cameras that might have caught the collision on tape. Road damage, foliage obscuring traffic signals, and other signs of lack of maintenance may point to negligence by a government entity. When all the evidence has been gathered, it is given to our lawyers. They use this evidence to deal on your behalf with the insurance company or prepare a strong case to present in civil court. This helps you obtain the personal injury damages you deserve.
