Rollover Crash on Happy Lane in Sacramento
A two-vehicle collision happened in Sacramento on January 28 that involved an overturned car. The accident happened on Happy Lane between Kiefer Boulevard and Old Placerville Road around 4:39 in the afternoon. According to the police report by the California Highway Patrol (CHP), one of the vehicles experienced a rollover and was blocking the roadway, while the other ended up on the front lawn of a home. Damage to the vehicles was major. Injuries were not reported in the accident as of this time. The CHP is investigating to determine fault.
The Dangers of Rollover Accidents
Rollovers are frequently traumatic and result in fatalities. This type of accident has the highest fatality rate with more than 10,000 people dying annually. The problem with rollover accidents is they bypass safety features, including seat belts. Because of this, passengers can be ejected from the vehicle due to the rollover alone.
Crushed Roof
In other cases, the structural support isn’t sufficient to keep the roof from caving in when the vehicle rolls. This can result in what is referred to as a crushed roof. In such cases, the weight of the vehicle crushes inward on the occupants, resulting in significant head and upper body injuries, including traumatic brain injury.
Who Is Responsible for Crushed Roof Injuries?
The responsibility for crushed roof injuries following a two-vehicle collision is carried by the manufacturer of the car. Automakers are instructed to provide ample infrastructure support that will sustain 3.5 times the vehicle’s weight. When this does not happen, the passenger compartment is not safe for the occupants.
When this happens, the injured party has a right to place a product liability claim against the manufacturer. In California, the claimant does not need to prove negligence. Instead, they must prove that, despite using the vehicle in the way in which it was intended without alteration, they were injured. This capability exists under California laws of strict liability.
Investigating a Rollover Accident
In a two-vehicle collision that ends with a rollover, our investigators examine the car or truck for a lack of structural integrity. That is why it is important to preserve the vehicle after a rollover accident. Our investigators also perform accident reconstruction that helps them in their quest to determine liability.
Speaking to witnesses who saw the accident happen is another important part of their investigation as is obtaining video footage of the two-vehicle collision. The investigators also review police reports for mistakes since they are widely used in negotiations with the insurance company and in civil court. Once all this information is gathered, it is handed over to our injury attorneys as they construct a robust case against the defendant.
Why You Need an Injury Lawyer
When confronting a rollover crash, there are many things that need to be done. Aside from gathering evidence as noted above, information has to be gathered on the losses suffered by the injured party and the expenses associated with their medical charges, lost wages and pain and suffering.
Once the case is closed and compensation is rendered and accepted, it is impossible to go back and revisit it. When further medical care is needed, the cost will be solely that of the injured party. Your attorney will ensure that no further treatment is needed and all aspects of the two-vehicle collision are covered before compensation is accepted.
