Nature of Car Accidents
Drivers know that anytime they get behind the wheel, a two-vehicle crash can happen. This can be the result of driver error or road defects. Regardless of the cause, several types of accidents are most common. These are:
- Rear-end crashes: These are the most common types of accidents in the country, accounting for 29.6 percent of all crashes. They usually are due to driver distraction and happen most commonly at intersections. While many are fender benders with low injury risk, others can result in both physical and financial harm. The most frequent injury in a rear-end accident is cervical strain and sprain, commonly called whiplash. Many times, the effects of this injury last for several months and resolve with rest. Some people feel the effects of whiplash for a year or longer. Common complaints are neck and upper back pain and headache.
- Rollovers: This type of accident accounts for roughly 2.3 percent of all crashes. Although rarer than other accident types, rollovers are often deadly. They occur when the vehicle’s infrastructure cannot support the weight of the vehicle, leading to roof crush. If the manufacturer failed to follow government recommendations for roof strength, your car accident lawyer can file a claim. It is important to preserve the evidence found after a rollover crash, so it can be examined by your law firm’s investigators.
- Head-on collisions: Although only 2 percent of all crashes are head-on collisions, they are often fatal. This is due to the fact that both cars contribute to the velocity of the impact, leading to greater injuries. This type of accident is often caused by drunk driving, the driver’s unfamiliarity with an area, or lack of proper signage, leading to confusion. The latter case is due to the lack of maintenance by the government agency in charge of road upkeep. Civil lawsuits against a government agency have a much different deadline in which an injured party can file. If this deadline, referred to as the statute of limitations, is missed, the claim can be dismissed due to exceeding the filing time limit. An experienced lawyer can file a lawsuit against the city, making sure to present all documents in a timely manner.
Investigation of a Two-Vehicle Crash
In order to prove negligence to support a client’s claim for compensation, an investigation must be conducted. Our reliable, experienced investigators leave no stone unturned to collect that evidence. They look for video footage from traffic and roadway surveillance cameras and conduct accident reconstruction.
The police report is reviewed for errors, witnesses are interviewed and photos are taken. In addition, the investigators look for signs of government negligence, such as overhanging foliage that obscured a sign or non-functioning traffic signals. Our lawyers use all of this evidence to build a strong case for court or to use when negotiating with the insurance carrier.
