Accident Near Camelia Memorial Cemetery Hospitalizes One Person
A two-vehicle crash reported in Sacramento County on June 26 caused a major injury to one individual. The crash happened around 12:22 in the afternoon along Jackson Road, southeast of Rosemont, in front of the Camelia Memorial Cemetery. The California Highway Patrol (CHP) reported that the accident occurred between a sedan and pickup truck, and Sacramento Fire Department paramedics were called to the scene to check those who were injured.
Two-Vehicle Crash Under Investigation to Determine Cause
One patient was determined to have suffered a major injury and was taken to a hospital for additional care and evaluation. The roadway was reported as clear shortly after 1:00 p.m. The two-vehicle crash is being investigated by the CHP to determine how it happened and to assign fault.
Why Claim Compensation Following an Accident Injury?
Many people who are injured in a two-vehicle crash end up hospitalized, some for extended periods, and lose money because they are unable to work. In addition, they have to go through the pain and suffering of their injuries. When a negligent driver or other entity was the cause, it is neither fair nor reasonable for the injured party to bear the financial burden. Instead, the at-fault party should be responsible.
What Damages Can Be Claimed in a Personal Injury?
Under California law, the injured party can claim the following:
- All medical expenses associated with the accident can be recovered. This includes any ambulance fees, hospitalization that isn’t covered by insurance, prescriptions, tests, rehabilitation and others. Even out-of-pocket expenses can be recovered, such as transportation to doctors’ appointments.
- Medical expenses after going home to recover can be claimed. These expenses can include a walker or other medical equipment, alterations made to the home that are needed and a home healthcare provider if it is prescribed by the physician.
- Lost wages are recoverable that include the salary, any bonuses, and other perks of the job.
- If the injured party has to take a cut in pay when they return to work because they can no longer perform their job, the difference in salary is recoverable.
- Pain and suffering include the physical pain as well as discomfort caused by the treatment for the injury.
- Emotional and psychological damages can be recovered if the injured party has to seek professional treatment. This can include mental anguish, sleeplessness or nightmares, anxiety, and post-traumatic stress disorder.
- Loss of consortium can be claimed as well as the loss of affection.
Can’t I Just Deal With the Insurance Company Myself?
In a minor fender-bender, most people just handle it themselves by dealing with the at-fault party’s insurance company. However, when injuries are involved, the settlement figure can go much higher, which can make the insurance company balk. They often offer a low figure, hoping that rising medical bills will cause the injured person to settle right away. It saves them a lot of money.
Unfortunately, the injured party may be in the hospital for a while, and the settlement won’t pay all of their expenses. Once an agreement is reached with the insurance company, the injured person can’t go back to them and ask for more. We’ve successfully handled many insurance claims by injured parties so that they obtain the compensation they deserve.
