Negligence in Accidents and Filing a Claim for Wrongful Death

Establishing negligence is pivotal when filing a wrongful death claim after a pedestrian accident. Even if the pedestrian is in a location where they are not supposed to be, motorists are expected to use caution to avoid an accident. Sometimes, this is not possible.

An injury attorney diligently investigates the incident to determine fault and gathers substantial evidence to support the family’s claim for damages. This process involves scrutinizing police reports, conducting witness interviews, and obtaining surveillance footage, among other investigative methods.

With the evidence collected, skilled injury lawyers craft a strong case to either negotiate with the at-fault party’s insurance company or pursue legal action in court. Although a vast majority of cases are settled through the at-fault person’s insurance company, in some cases, they balk at paying what the family deserves. In these cases, the evidence that was compiled can be used to take the case to civil court, where it will be decided.

Wrongful Death Recoverable Compensation

Families who lose a loved one in a fatal pedestrian accident due to another’s negligence may be entitled to considerable compensation. The decedent’s surviving spouse, partner, or children typically file the claim. In the absence of a spouse or children, other relatives, like siblings or parents, may step in to file the claim. Recoverable damages can include:

  • Reimbursement for funeral and burial expenses
  • The deceased’s expected earnings until their projected retirement age, including their insurance and pension benefits, bonuses and others
  • Compensation for losses suffered by spouses and children
  • The economic value of household chores the deceased performed, which now require outsourcing, such as caring for the lawn, vehicles and preparing the tax returns
  • Potentially other forms of compensation depend on the case specifics
