Rollover on Elkhorn Boulevard Requires Emergency Extraction

A vehicle rollover occurred in Natomas recently that sent at least two individuals to the hospital. The single-vehicle collision occurred around 10:40 in the evening along Elkhorn Boulevard at the intersection with East Commerce, according to the report by the Sacramento Police Department. Officers with the California Highway Patrol (CHP) and Sac Fire were also at the scene to offer assistance.

Upon arrival, it was discovered that a vehicle had exited the roadway and experienced a rollover, trapping at least two individuals inside. Fire personnel used cutters to get into the vehicle and extricate the people inside. Of those transported to the hospital with injuries, no information was provided about their conditions. The accident is under investigation by local authorities to determine how it happened.

Dangers of Rollover Accidents

Rollovers are among the most dangerous types of accidents and often cause serious injuries and fatalities. One of the problems is that the airbags may not be sufficient protection. After they inflate, they deflate quickly, offering no further protection for those inside as they are tossed around in the car. In addition, the occupants inside the vehicle may be ejected during a rollover, which is a high cause of fatalities. These deaths can be due to a defective seat belt, which doesn’t hold when the user needs it the most.

Roof Crush and Rollovers

Another problem is that the strength of the top of the vehicle may not be sufficient to prevent roof crush, which can have devastating consequences. Roof crush can cause traumatic brain injuries and cause damage to the spine. Because manufacturers are held to a certain standard when it comes to roof strength, they can be held financially responsible for those injuries. This is one of the reasons it is important to retain the vehicle following a rollover crash, so it can be examined for roof strength.

Investigating a Rollover Accident

Evidence is key to a successful rollover accident claim. This is important since it is on the plaintiff to prove that negligence was the cause of the crash. In an accident rollover, other factors come into play. Since manufacturer liability can be an element in a rollover crash and subsequent roof crush, our investigators start by examining the vehicle for an infrastructure that is unable to support the weight of the car when it flips over.

If manufacturer negligence is involved in the accident rollover, a product liability claim will be filed against the carmaker. In California, it is unnecessary to prove negligence. Instead, it is sufficient to show that the defect exists, and due to that, the accident happened and caused injury or death.

In addition to this, our investigators will examine the site to see if another vehicle was involved in the crash. Sometimes, a hit and run occurs, and the fleeing vehicle causes the other car to rollover. If that happens and the fleeing vehicle is not found, it is possible for the injured parties to use their own uninsured/underinsured motorist policy to cover the damages. Even if this is lacking and another family member has this protection, it can be used without any increase in premiums.

Our investigators also interview witnesses to the crash and review police reports of the accident rollover. We obtain videos from surveillance cameras as well as use accident reconstruction techniques to determine liability. Once the data is available, our lawyers use it as they construct a strong case for our clients.
