State Route 299 Collision Results in Pedestrian Major Injury

A pedestrian major injury accident was reported in Weaverville on September 14. The accident report said that the crash occurred when a driver struck the pedestrian on State Route 299 at S.R. 3 in front of the U-Haul truck rental. California Highway Patrol (CHP) officers arrived to discover a female lying on the westbound side of the roadway. She had been thrown in the air by the impact of the vehicle.

Vehicle Reportedly Located in Pedestrian Major Injury Crash

The vehicle in question kept heading westbound along S.R. 299, and was reportedly moving fast. However, the CHP had a unit close by to respond and located the vehicle on the west side of a parking lot. It was towed as evidence. Information was not provided on whether the driver was located. An investigation into the cause of the crash is being conducted by the CHP traffic unit.

Filing an Injury Claim Within the Statute of Limitations

Most injury claims must be filed within the two-year statute of limitations in California. The clock starts ticking the day of the accident. That time limit can change if the injury involves medical negligence or the injured party is a minor. If the injured pedestrian waits too long, the court will refuse to hear their case. In addition, important evidence can be lost and witnesses may move, which further complicates finding the proof to support your claim.

Is It Worthwhile to File a Personal Injury Claim?

Because people on foot are so vulnerable when they are struck by a motor vehicle, a pedestrian major injury accident can be financially devastating. Hospitalization, mounting doctors’ bills, potential surgeries and other costs can be overwhelming. Being out of work because of the pedestrian major injury can also place a real strain on someone’s pocketbook. By placing a personal injury claim against the negligent person/entity, the injured pedestrian can help avoid these financial losses.

Dealing With Pain and Suffering

A large percentage of those who are in an accident suffer not just physical but emotional trauma as a result. According to the National Institutes of Health, about 24 percent of those involved in traffic collisions develop post-traumatic stress disorder as a result. Those who are represented by an injury lawyer can recover compensation for their pain and suffering, including emotional trauma.
