Determining Who Can File a Wrongful Death Lawsuit
A wrongful death lawsuit is a legal avenue for grieving families to seek justice after a loved one is lost due to negligence or intentional harm in a Sacramento fatal crash. The right to initiate such a lawsuit primarily belongs to the deceased’s closest relatives, starting with the spouse and then children, who are legally entitled to pursue justice and seek compensation for their loss. If these direct heirs are absent, the deceased’s parents and siblings may be able to file the lawsuit.
When no immediate family members are eligible or available to pursue the case, the executor or administrator of the deceased’s estate may be granted the right to file the claim. It is important to note that the law limits the opportunity to one wrongful death lawsuit per incident.
Types of Compensation in West Sacramento Wrongful Death Claims
When dealing with a wrongful death claim following a West Sacramento fatal crash, there are several forms of compensation that survivors may be eligible to pursue:
- Funeral and Burial Costs: Compensation may cover funeral, burial, or cremation expenses.
- Loss of Future Earnings: Survivors can seek compensation for the earnings the deceased would have provided up to their retirement.
- Loss of Spousal Support: A surviving spouse may claim for the loss of affection, love, and companionship.
- Loss of Parental Guidance: Children of the deceased might pursue damages for the absence of parental support and guidance after a West Sacramento fatal crash.
- Value of Household Services: This includes vehicle and lawn maintenance, childcare, laundry, meal preparations and others.
- Punitive Damages: In circumstances involving gross negligence, such as DUI, punitive damages may also be sought.
