Details on the Wheel-Off Truck Accident Fatality on I-5
A preliminary report by the California Highway Patrol indicated that a tire popped off a concrete pumping trailer towed by a 2019 Chevrolet pickup truck. The vehicle was headed southbound at the time of the incident. The tire allegedly veered over the guardrail and struck the front of a northbound Toyota Sienna.
Sadly, the Toyota Sienna driver, Carlos Castaneda Valencia, 40, of Stockton, sustained fatal injuries in the wheel-off truck accident. A GoFundMe page has been set up for Carlos Castaneda in support of his surviving wife and three children.
Four occupants in the Toyota were transported to the hospital for treatment of injuries described as minor. The Chevrolet driver stopped and cooperated with officials in the investigation. It is not yet known what caused the tire to detach from the trailer, the CHP reported.
Taking Legal Action in a Fatal Car Accident Case
Amidst such a heartbreaking time, the prospect of filing a wrongful death claim is likely the least of concerns for surviving family members. Nevertheless, it is essential to recognize that time is an important factor in these cases. Despite the overwhelming grief, taking legal action is essential for holding the opposing party accountable and obtaining justice for the deceased. Delaying legal action may result in a missed opportunity for survivors to obtain financial compensation at a time when it is needed the most to cover unexpected expenses and losses for the family household.
To bring a case, it must be proven that the defendant caused the fatal incident and survivors have incurred damages as a consequence. Whether responsibility lies with an individual or an entity, those left behind by the decedent may have the right to seek compensation for their loss. However, given the various circumstances that can lead to a fatal accident, several factors must be considered when determining a reasonable settlement agreement. These factors include how the fatality occurred, who is responsible for the incident, the extent of damages suffered by the family, and more.
The laws regarding who is eligible for compensation in a wrongful death claim and priority for filing may be challenging to navigate. In the state of California, a wrongful death claim can be brought by the deceased’s children, domestic partner, or spouse. Under the CCP 377.60, these are parties with priority for filing. Other relatives may be able to file a case if the deceased is not survived by the spouse, domestic partner, or child.
