Loss of a Loved One in a Turlock Pedestrian Accident
Coming to terms with the sudden loss of a close relative may be challenging for survivors. They are often overwhelmed by the reality that they did not have a chance to say goodbye and often face feelings of shock, disbelief, and grief. In times like these, friends and family can help support those affected by bereavement in offering to help with arranging funeral and burial services. They can also accompany the grieving person by taking them out to eat and offering a sympathetic ear as they are adjusting to the loss.
How Are Wrongful Death Settlements Paid Out?
When a loved one passes away due to the negligence of a driver or entity, specific relatives of the deceased may be able to file a wrongful death claim for damages incurred. Economic damages, or special damages, are actual losses that have been suffered by the surviving family of the decedent. These include funeral expenses, burial costs, lost inheritance, and loss of a family member’s future financial support and benefits. Noneconomic damages, or general damages, are losses that are subjective and challenging to place a value on. They may include mental anguish, emotional suffering, and loss of a loved one’s care, companionship, guidance, and protection. Punitive damages may be awarded in cases of egregious misconduct, like excessive speeding or driving while intoxicated. For more details on wrongful death cases, watch the video below.
Who Can Bring a Wrongful Death Claim?
Wrongful death claims cannot be brought by just anyone. Under the California Code of Civil Procedure Section 377.60, only the surviving spouse, domestic partner, or children of the decedent may be able to file a claim against the driver responsible for their loved one’s wrongful death. If such parties are nonexistent, a wrongful death action may be brought by and for the benefit of surviving parents, stepchildren, putative spouses, and children of the putative spouse. If you are unsure whether you are eligible to file for wrongful death, contact an experienced attorney.
Is There a Time Limit on Wrongful Death Cases?
In California, there is a two-year statute of limitations for filing a wrongful death claim. Failing to meet the deadline may cause the family to lose the right to take legal action and obtain compensation for their loved one’s wrongful death. This is why it is essential to work with an experienced wrongful death attorney from Turlock. An attorney can ensure all statutory deadlines and criteria are met so surviving family members can focus on healing and grieving.
