Placing a Wrongful Death Claim
Families have the right to place a claim to recover damages in a wrongful death if their loved one was not at fault for the accident. Fault can be determined by an accident attorney when they conduct an investigation into the cause. Some of the areas in which investigative techniques are used include:
- Reviewing the circumstances leading up to the accident
- Speaking with witnesses who saw what happened
- Examining physical evidence from the accident scene
- Analyzing any video footage of the accident, if available
- Getting expert opinions on various aspects of the case
What Damages Can Be Recovered in a California Wrongful Death Claim?
After gathering all of this information, a personal injury lawyer will be able to determine whether or not another party was at fault for the accident and can help families pursue a wrongful death claim accordingly. The death of a loved one is always a difficult thing to deal with. If the death was caused by the negligence or intentional act of another, it could be even more difficult.
You may be wondering what, if anything, you can do to recover damages. In California, there are certain types of damages that can be recovered in a wrongful death claim. These include:
- Funeral and burial expenses
- Loss of earnings and benefits
- Loss of companionship, consortium and love
- Mental anguish and suffering
- Punitive damages (in some cases)
Depending on the circumstances, you may also be able to recover other damages, such as property damage.
If a loved one died due to an intentional act of another or negligence, you might be entitled to compensation. An experienced wrongful death attorney can help you understand your legal rights and options.
